WHO ARE WE?

Bologna’s Chamber of Commerce is an essential point of reference on Bologna’s socio-economic world.

The mission of Bologna’s Chamber of Commerce consists in carrying out functions of general interest within the private business system.

Bologna’s Chamber of Commerce carries out important functions in the administrative area (the most important being “the business register”), offers enterprises a full range of services to facilitate market intelligence and skilled training, to stimulate companies and businesses in innovative efforts and to support business trade relations in Italy and abroad.

The members of the Council of Bologna’s Chamber of Commerce are appointed by the organisations representing the enterprises operating in major economic sectors, (proportionally to their presence in the province), as well as by workers unions, users and consumer associations.

Therefore, the Chamber of Commerce is a “shared home” for enterprises and various businessmen.

The Chamber of Commerce of Bologna offers many instruments and initiatives. Its main functions are:

  • Administration services: updating of business registers, lists, etc. where all the data on firms and enterprises are registered.
  • Promotional activities: supporting business and  its development, protection of  the local economy.
  • Analysis, studies on the  local market: collecting  all the necessary information in order to detail  the economic situation of the area.
  • Market regulation functions: to better up the levels of transparency on economic relations between consumers and  enterprises.
  • Entrepreneurial training: in order to guarantee to whoever wants to start a business the correct information, orientation and knowledge to build a solid company.
  • Development of metropolitan infrastructures.

The Chamber of Commerce of Bologna, as “home of the enterprises of Bologna” and governmental institution, guarantees  protection to the local market and the correct development of economical and commercial transactions; these important duties assure the safeguard of firms, enterprises, consumers and workers.

The Chamber has many of its offices in Palazzo Affari but the head offices are in Palazzo della Mercanzia.

In addition to its fundamental functions, the Chamber of Commerce of Bologna is the majority partner of Bologna’s airport born as a special Chamber Of Commerce enterprise. Bologna’s Guglielmo Marconi Airport is one of the best Italian airports in number of international destinations and with a runway authorized to handle flights travelling as far as five thousand sea miles and can boast as having the very latest environmental protection/security technology.

The Chamber of Commerce of Bologna is also an important member and has contributed to the birth of:

Bologna Fiere, one of the leading European exhibition organizers and one of the most advanced show centers worldwide.

BolognaFiere Group manages three exhibition centers (Bologna, Modena, and Ferrara) with over 75 outstanding exhibitions in Italy and abroad; Bologna Fiere Group consists of several companies that offer an extensive range of events and provides businesses with all of the promotion and specialized services they need to successfully participate in each exhibition.

  • The Interporto Bologna SpA is a joint stock company which began in 1971 with the aim of designing, building and managing the Bologna freight village (interporto), an integrated complex of infrastructure, facilities and services that enable the smooth functioning of the site and satisfy the requirements of the operators dealing with logistics and/or intermodal transport activities.

Moreover, to achieve better results in supporting local business and enterprises, the Chamber of Commerce has set-up 2 special companies. The Special Agencies are directly connected to the Chamber  and  pursue the objectives of the Chamber itself.

  • CTC, that operates in management training;
  • Prosim, which manages the conference rooms at Palazzo Affari.

As a governmental institution, it is a member of the Unioncamere, a network that links all the Chambers Of Commerce in Italy, which are  part of a national system that provides real-time data from each Chamber throughout the national territory.

 

REGISTER OF BUSINESS AND LISTS

All the Italian enterprises and firms (over 6 millions) must be enrolled in the register of business, which is the primary certification of their data, like the municipal registries are for their citizens: whoever conducts an economic activity in Italy as an enterprise or firm, must be registered in the business register of the Italian Chambers Of Commerce.
Thanks to the activity connected to the constant updating of lists and registers and the inspective activity of the Chamber of Commerce, the economic operators and consumers have the opportunity to control at any time the credibility and the activities of their interlocutors.

With a view to guaranteeing the permanent updating of the business information system, Bologna’s Chambers of Commerce provides a significant amount of information concerning rules, regulations and the possibility to benefit from tax concessions or access credit.

Connected to the Registry is the Financial-Administrative Inventory (R.E.A.) which collects all financial, statistical and administrative data concerning firms and associations carrying out business activities.

Besides these registry tools, there are other registers, rolls, rosters and lists with a validating function.

 

INCENTIVES TO ENTERPRISES – EXTERNAL PROMOTION

The Chamber of Commerce has support and promotion functions for the general interests of the companies under its territorial jurisdiction. It has also the aim to develop appropriate local administration strategies and to foster and support the development and regulation of the market.
The promotional activities’ target is to promote and stimulate the local entrepreneurial system through:

  • training
  • access to financing
  • access to technological innovation
  • information and consultation
  • helpdesks

The Chamber also provides information and services to steer those who want to know the real opportunities of a global market, setting up the internationalisation process. 

 

MARKET HARMONISATION

The Bologna Chamber of Commerce works on  market harmonisation with the aim to reach the maximum of transparency and the balance between demand and supply of goods and services. The Chamber sets its activities according to the collection of data on local economy and its analysis.

Patents and trademarks

Patent rights consist in the power to exclusively implement any invention or model and make it profitable or to exclusively use a brand and apply to the court against those who try to contend or encroach on this right.

Anything entailing a creative activity and allowing industrial implementation can be patented. The main patent categories are the following:

  • Industrial inventions
  • Industrial models (utility models and ornamental models and designs)
  • New vegetable varieties
  • Trademarks
  • Collective trademarks

Patent applications must be filed with the Italian Patent and Trademark Office and  the Chambers of Commerce. The Chamber Office task consists in drawing up the minutes on a suitable register, signed by the applicant and undersigned by the Chamber officer in his quality as a party to a notary’s deed.
Said minutes must contain, among other things, the application date, the name and domicile of the applicant and of his/her agent, the title of the industrial invention or industrial model or the enterprise trademark, and the documents produced. A copy of the minutes, together with the application and documents, are sent to the Italian patent and trademark office for additional formalities and registration, whereas another copy is issued, upon request, to the applicant. After examining the patent application and minutes drawn up by the Chamber of Commerce, the Italian patent and trademark office issues a patent certificate.

As a protection to the owner, the patent transcription in the Patent Register is made in order to guarantee the title of the right itself, since any change in the title must be registered. In fact, in the event of a patent ownership transfer, or should any ownership change occur, the assignee must either personally or through an agent, file the transcription note to the Chamber of Commerce or to the Italian patent and trademark office; it shall be drawn up in duplicate, on stamped paper and signed by the assignee or his/her agent.

Said note must contain the names, nationality and domicile of the assignor and assignee, the date, nature of the title that is intended to be transcribed and, for public deeds, the name of the notary that received it; it shall also indicate the reference number of the registration of the title at the Registry and the statement of rights, including the number and date of the patent, trademark or model. If the deed to be transcribed relates to several patents, trademarks or models, the same number of samples in unstamped paper must be presented for each patent, trademark or model besides the first one. For transcriptions by succession, the owner’s death certificate and the certificate of succession notification must be produced.
Should the rights concerning patents, models and trademarks be simultaneously transferred with one title, separate transcriptions must be requested by producing copies in unstamped paper of the sole title, together with all the above-mentioned documents,

The documents drawn up in other languages must be complemented by the Italian translation, certified and authenticated before the relevant Italian authorities.

Legal metrology

Legal metrology deals with measurement units, methods and tools, and guarantees the accuracy of measurements used for commercial transactions.

The metric offices of the Chambers of Commerce are responsible for guaranteeing, at a provincial level, public faith in any business relation. In other words, they aim at allowing transparent trade operations and promoting market self-control. Their tasks also include inspections on measurement tools; metrological control of pre-packed products; and the granting of hallmarks, marking objects manufactured and put on sale. The metrical offices also deal with the legal metrology regulation infringements, and metrical inspectors can inflict the financial penalties provided for by the regulations in force.

The Paris-based International Organisation of Legal Metrology (IOLM) was established with a view to favouring trade between countries with different legislations; almost all world countries joined said organisation which aims at harmonising metrological control procedures.

Commodity exchange and Prices

The commodity exchange is the place for the bargaining of goods, products and services which can be commercial objects.
The operators which want to enter the Exchange must not be declared bankrupt or condemned for crime against the public trust or property, for embezzlement, extortion, corruption, subtraction from public storage locations, perjury and slander; they must not be excluded from other Commodity Exchange or Trading Floors; they must not have failed their commercial commitments.

The office provides information on market trends for different agricultural products.
The Bologna Chamber of Commerce finds wholesale prices on the market of Bologna of the following products: cereals, flour, seeds, fruit and vegetable products, biological agricultural products, wine, grapes, forages, swine, dairy produce, oil products. 

 

ARBITRATION


What is it?

It is a way to resolve economical and commercial disputes. Using the arbitration the parties assume the responsibility to commit the resolution of the dispute between them to one or more judges chosen by the parties themselves, excluding  recourse to an ordinary court.

How to?

To put arbitration into practice it is necessary to insert a special clause in the contract. The Arbitration Chambers assist the parties concerned and the arbiters along all of the arbitral process.

Types:

  • Arbitrato Rituale (Ritual Arbitration): is a process that consents the resolution of disputes in form of binding arbitration between the parties, which can take judgmental effect in accordance with  procedural law.
  • Arbitrato Irrituale o Libero (Non Ritual or Free Arbitration) is a process aimed at a decision having negotiating value between the parties.

Benefits:

The benefits of the arbitration compared to ordinary justice are: rapidity, reservation, minor costs and the huge technical competence of the arbiters.

The legitimating of arbitration originates from the Code of Civil Procedure, which states that the parties can decide to entrust arbitrators with the settlement of disputes . In other words, the submission of the dispute to arbitration must be established by the parties, through an arbitration clause included in the agreement they sign. In default of said arbitration clause, once the dispute originates, the parties can have recourse to arbitration through the above-mentioned arbitration clause, that must be requested in writing and indicate the subject-matter of the dispute, subject to invalidity.

The arbitration clause must name the arbitration Chamber to be applied in case of dispute; with assignment of arbitrators, or shall fix their number and the appointment procedures.

The decision of the board of arbitrators is called award; it must be decided by a majority of votes and it must be in writing. It must show dates and place of the arbitration agreement, besides a brief presentation of the reasons for the arbitration decision and the final ruling.

CONCILIATION


What is it?

Conciliation is the simplest, cheapest, and fastest way to solve a dispute.

It is a tool for the settlement of disputes arising between enterprises or between enterprises and consumers and aims at coming to an amicable dispute settlement. The parties can find a common and agreed solution that ends the dispute with the aid of a neutral and impartial third party.

Just as for disputes between two or more parties the intervention of a third party is envisaged, in conciliation there is also the intervention by an impartial and neutral third party; however, while in the first case intervention aims at settling the dispute, in the second case a third party intervention aims at developing negotiations between the parties involved.

The conciliation procedure envisages that the disputing parties are guided by the third neutral party through the achievement of an agreement of mutual satisfaction. Conciliation Commissions are established at the Chambers of Commerce and, in consideration of the nature of the latter, offer the advantage of guaranteeing a greater impartiality.

No decision is imposed: if the conciliation is successful, the parties subscribe to an agreement that has contractual value. If the agreement is approved by the President of The Court in which administrative district resides the Mediation Body, it constitutes executive title, for the purpose of forced expropriation, execution in specific form and court registration.

The parties can abandon the process at any time and call on an ordinary court.

How to?

It is enough that one of the parties introduces to the Chamber of Commerce a simple request which indicates who they are and what is the problem. The office will then contact the other parties and organize the process. 

 

SPORTELLO SICUREZZA PRODOTTO

 

What is it?

"Inform and prevent", this key-formula is perfect to describe synthetically the “Sportello Sicurezza Prodotto”, which is a service promoted by the Chamber of Commerce of Bologna for the final consumers and economical operators (producers, importers, distributors and retailers) in order to promote the culture of safety.

This input comes directly from the European Union and originates from the triple need to match the norms of the State members in terms of products’ safety, to guarantee the mechanisms of  competition inside the European Union and to prevent  incidents related to the use of the products. The Ministry of Industry, in order to establish this input, has signed the 11th of July 2000, the agreement Protocol with the National Union of Chambers of Commerce “to enforce the functions of surveillance of the market and protection of the consumer”.

The Sportello gathers, classifies and makes available to the users the national and European norm in terms of products safety and is capable of providing all the information, or references, of  technical, legal and administrative regulations, about planning, production, labeling, advertising and presentation of products, that can be alimentary or non alimentary.

The publication of the legal and technical norm does not conclude the services of the Sportello; other elements, which are important for economical operators and citizens, find place within the service.

The offices are open to the public from Monday to Friday from 8.45 a.m. to 12.45 a.m. On  Monday and on Thursday from 3.00 p.m. to 4.30 p.m.

Exclusively for official communications, which need a registration of protocollo and the activation of an administrative procedure, the certificate electronic mail address is: cciaa@bo.legalmail.camcom.it.
It actives the registration of communications received by PEI, PEC and PA.

The communications received by simple electronic mail address will be refused through an automatic notification.

STATISTICS, STUDIES AND ECONOMIC INFORMATION

The Statistical Office of the Bologna Chamber of Commerce promotes and realizes the collection, elaboration,  spread and  archiving of statistical data on the Provincia of Bologna also through  commerce registers. Moreover, it undertakes, on behalf of  ISTAT, the provincial coordination of official statistics.

The service addresses to enterprises, professionals, students, teachers, families and organizations working in the fields of agriculture, industry, trade and services.

The data of the Statistical Office are available on the website divided by topic. Furthermore, the service provides for free statistical tables on the consistency of the provincial enterprises.

The requests must be sent preferably through e-mail (requests through fax or ordinary letter are also admitted) exclusively to the email address of the office: statistica@bo.camcom.it
